Copyright Law Summary/Definitions - Emerald
Copyright Law confers exclusive legal rights on copyright owners as detailed in National, European and International laws. The following definitions are provided for the purpose of clarification of Emerald's Copyright Policy and are not intended for use without reference to the wider context of Copyright Legislation. (Source: UK Copyright Act 1988)
* A person who creates an original literary, dramatic, musical or artistic work is the prime owner of intellectual property.
* Copyright is the legal right of the author or owner of intellectual property to control the copying of that work. (Chapter II)
* A copyright owner has the exclusive right to: copy, adapt, publicly perform, display or distribute the work to the public by any means (II, 16:1) and to authorize others to do the same either by licensing certain agreed rights or by the transfer (assignment) of ownership.
* Copyright is infringed by a person who, without the licence of the copyright owner, does or authorizes others to do any of the acts restricted by copyright. (II, 16)
* Fair Dealing for the purpose of (non commercial*) research, private study, criticism or review, reporting of current events or for instruction or examination does not infringe any copyright in the work provided that it is accompanied by sufficient acknowledgement. (II, 29:36). (This concept is dealt with under US law as Fair Use).
Authors' Moral Rights
The author of the work has the right to:
* Be identified as the author (the right of the attribution) (IV 77:79)
* Object to derogatory treatment of your work. "Treatment" refers to any addition to, deletion from, alteration or adaptation (other than translation) which amounts to distortion or mutilation of the work or is otherwise prejudicial to the honour or reputation of the author. (IV: 80-83)
* Not have a work falsely attributed to him/her as the author. (IV:84)
Full details of national copyright legislation is available from the UNESCO Web Site.
(* Please note that recent changes to Copyright Law have defined Fair Dealing for research as only applying in instances where this is for a non commercial purpose. (See Changes to UK Law for further information and guidance)
